By accessing or using Third Gear Shop ("the Service"), operated by Third Gear Ventures LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
Third Gear Shop is a cloud-based shop management platform designed for automotive repair and performance shops. The Service includes job tracking, invoicing, customer management, parts inventory, technician management, time tracking, and reporting features.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized access. One person or legal entity may not maintain more than one free account.
Paid plans are billed monthly or annually in advance. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice. Your subscription will automatically renew unless cancelled before the renewal date. Cancellation takes effect at the end of the current billing period.
We may offer a free trial period. At the end of the trial, you must subscribe to a paid plan to continue using the Service. We reserve the right to modify or discontinue the trial at any time.
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorized access to the Service or its systems; (c) interfere with or disrupt the Service; (d) upload malicious code; (e) resell or redistribute the Service without authorization; (f) use the Service to store or transmit content that infringes third-party rights.
You retain ownership of all data you upload to the Service ("Your Data"). You grant us a limited license to use Your Data solely to provide and improve the Service. We will not sell Your Data to third parties. You may export or delete Your Data at any time through the Service.
The Service, including its design, code, and branding, is owned by Third Gear Ventures LLC and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets.
To the maximum extent permitted by law, Third Gear Ventures LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.
We may suspend or terminate your access to the Service at any time for violation of these Terms. You may cancel your account at any time. Upon termination, your right to use the Service ceases immediately. We will make Your Data available for export for 30 days following termination.
We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles. Any disputes shall be resolved in the state or federal courts located in Delaware.
